The Save Malaysia Stop Lynas (SMSL) group will file an injunction in the courts to stop the newly-issued temporary operating license (TOL) to rare earth miner Lynas for its plant in Gebeng, Kuantan from being in force, pending the conclusion of two legal actions it is currently pursuing.
"We have instructed our lawyers to file an injunction for a stay of the TOL (from being in force)," a SMSL spokesperon toldMalaysiakini.
This, he explained, is pending two judicial review applications filed by SMSL in the Kuantan High Court.
The first is a judicial review of the award of a temporary operating licence (TOL) to Lynas Advanced Materials Plant (Lamp) by the Atomic Energy Licensing Board (AELB), and the second is for the Science, Technology and Innovation Minister Maxmimus Ongkili's decision to reject their appeal against the same.
The TOL, however, was issued by the AELB today to the Australian rare earth miner.
"Our lawyers have written to AELB to ask for a stay of the TOL until our legal actions have concluded and we are supposed to hear from them on Sept 10, But they have jumped the gun and issued the license today," Tan lamented .
